FACTS: The buyer and seller executed an AAR Residential Resale Real Estate Purchase Contract (“Contract”) for a condominium.  The condominium owner does not have a homeowner’s insurance policy.  Rather, the policy is purchased and maintained by the homeowners’ association that governs the condominium.  The property manager refuses to provide a copy of the insurance claims history for the condominium project to the condominium owner.

ISSUE: Is the condominium owner required to provide a claims history for the entire condominium project as part of the Contract.

ANSWER: No.

DISCUSSION:

Section 4b of the Contract requires the seller to provide a five year insurance claims history for the Premises.  The Premises in turn is defined as the real property being sold in Section 1b of the Contract.  Thus, there is no contractual obligation to provide an insurance history for the entire project.  The claims history need only address the Premises.
